Terms and Conditions of Use and Sale

These terms govern the use of the Perform'Ace service (site performace.fr and app app.performace.fr). By creating an account, you accept them.

1. Publisher

The service is published by Perform'Ace, a French micro-enterprise, 107893216. Contact: contact@performace.fr.

2. Service description

Perform'Ace automatically analyzes amateur tennis videos and extracts stroke cuts (serve, forehand, backhand, points) and indicative statistics. You film with your phone, upload the video, and receive the results.

Indicative results. The detections (strokes, rallies, positions, bounces) are produced by automated models and may contain errors. They are provided for informational purposes and do not constitute any guarantee of accuracy. The analysis focuses mainly on the player in the foreground (near side of the court).

Payments are processed by Stripe, which acts as "Merchant of Record" for these transactions. As such, Stripe collects the payment, handles the applicable VAT and issues the corresponding invoice/receipt. No card data is stored by Perform'Ace.

6. Right of withdrawal

Under consumer law, you generally have a 14-day withdrawal period for distance purchases. As this is digital content/a digital service, by purchasing a pack and starting to use it, you request its immediate performance and acknowledge that the right of withdrawal no longer applies to hours already consumed.

8. Acceptable use

You undertake not to misuse the service (circumventing limits, unauthorized resale, security breaches, uploading illegal content). We may suspend an account in case of abuse.

9. Availability and liability

The service is provided "as is", without any guarantee of continuous availability. To the extent permitted by law, Perform'Ace's liability is limited to the amount paid by you over the last 12 months. Nothing herein limits any liability that cannot lawfully be limited.

10. Termination

You can delete your account at any time. Hours not consumed at the time of a voluntary termination are not refunded. We may terminate or suspend access in case of breach of these terms.

11. Governing law and disputes

These terms are governed by French law. In case of a dispute, an amicable solution will be sought first; consumers may use a consumer mediator free of charge.

12. Changes

We may amend these terms. The last-updated date is shown at the top of the page; the applicable version is the one in force at the time of your use.
